Terms and Conditions Boreal-Plus

 

The www.boreal-plus.ro website is owned by Impact Developer & Contractor SA, a Romanian legal entity established in Bucharest,  172-176 Bucuresti-Ploiesti Road, Willbrook Platinum Covention Center, Building A, Floor 1, Office no. 1, District 1, registered at the Trade Register under no. J40/7228/2018, with Fiscal Code RO1553483, bank account no. RO83BTRL05001202G09191XX opened with Transilvania Bank, company which will process the personal data of the users of the site.

Accessing, visiting and / or using the site implies full and unconditional acceptance by the user of the conditions set out in these Terms and Conditions. Unless you agree to these terms, you have the right to immediately cease using the site.

  1. General specifications

The www.boreal-plus.ro website is a presentation site for the BOREAL PLUS CONSTANTA residential project as well as an information site on the residential complexes built within the IMPACT Developer & Contractor Group, which also includes the affiliated companies Greenfield Copou Residence SRL, Bergamot Development SRL  and Actual Invest House SRL and aims to facilitate access to information on the availability and possibilities of purchasing an apartment within these residential complexes from the Group.

The information presented on the site is informative, the exact contractual conditions (including price) being established directly with the developer’s representatives.

  1. Definitions

User – anyone who accesses, browses and / or uses the site or subscribes to the newsletter.

Newsletter – any news, information, novelty related to the offers and events organized by Boreal Plus Constanta and the other companies in the IMPACT Group sent to the users that had subscribed to the newsletter module within the site.

Sale offer – the offer of apartments for sale published on the site, valid within the available inventory. In order to find out the available inventory, it is necessary to contact the sales representatives. Due to technical and objective reasons related to the very rapid updating and modification of offers, it is not possible to publish the exact offers available at any given time.

Client – any adult individual or legal person who accesses the site and addresses www.boreal-plus.ro to request an offer for the purpose of purchasing an apartment or to request the scheduling of an apartment viewing.

  1. Intellectual property rights

The entire content of the site – images, texts, graphics, symbols, web graphics – is the property of the site owner and their collaborators, the intellectual property rights being protected by law. No material on this site may be reproduced in whole or in part and / or modified without the prior express consent of the intellectual property right owner.

All information presented on the site regarding the products (selection of apartments) including prices, information, availability of apartments is presented for information purposes and does not represent a firm offer to contract and cannot engage the responsibility of Impact Developer & Contractor SA in the absence of subsequent agreements.

  1. Exemption from liability

Impact Developer & Contractor SA does not guarantee that the use of the site and the servers on which it is hosted or that downloading materials from the website does not present a risk of virus or transmission of other potentially harmful information components. Therefore, it will not be liable for any direct or indirect damages caused by accessing / visiting / using the site and the information on it.

Impact Developer & Contractor SA does not guarantee the content and use of the website and  can’t be held responsible for any inconsistencies, unavailability or other defects of the site or its content, caused by objective causes.

  1. Data privacy and Personal data protection policy

Impact Developer & Contractor SA guarantees the confidentiality of all data and information provided by clients.

Impact Developer & Contractor SA  guarantees that it complies with the legal provisions regarding the protection of personal data, including Regulation no. 679 of  April 27th, 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing the Directive 95/46/EC (General Data Protection Regulation).

All users are subject to all relevant rights regarding the protection of personal data (for example the right to information, right to access, right to rectify, right to restrict processing, right to portability, right to object, right to delete and the right to go to court) on the protection of individuals with regard to the processing of personal data and on the free movement of such data.

Any personal data of users such as last name, first name, telephone number or e-mail address collected through the site or communicated by e-mail or otherwise will be kept confidential and will not be disclosed to third parties.

The processing of personal data is performed in accordance with and for the purposes provided in the Privacy Policy and the Cookies Policy and the Privacy Notice.

  1. Newsletter

Users can subscribe to the newsletter service by filling in the specific fields on the site (name and e-mail address), the data being used for the purpose of sending information messages about products and events held within BOREAL PLUS CONSTANTA and other companies in the IMPACT Group, in compliance with the legal provisions in force. The user has the possibility to cancel the newsletter service at any time and free of charge by checking the “Unsubscribe” option in the newsletter or by sending a written request to the e-mail address dpo@impactsa.ro, through which one expressly requests unsubscribing from the newsletter service.

  1. Fraud

Impact Developer & Contractor SA  implemented measures to reduce the risks of human error, theft, data and information fraud, implementing procedures and standards to protect the information collected and stored in computer environments.

 

 

  1. Limitation of liability

Use of this site is at the user’s own risk. The site is provided as is available, “as it is” and “as available”, respectively, without representations or warranties (for example availability, accuracy, or full form), Impact Developer & Contractor SA and its affiliates limiting their liability to any and all of the foregoing.

Use of the site may be affected by a number of factors beyond the control of Impact Developer & Contractor SA.

Impact Developer & Contractor SA  and its affiliates will not be liable to users or other third parties for any damage suffered as a result of any event and for any damage suffered by the user as a result of any operational failure, modification, or withdrawal of the site. Consequently, the content of the website is available without warranties, express or implied, including but not limited to the accuracy, timeliness and / or completeness of the information provided.

  1. Force majeure

Impact Developer & Contractor SA  will not be held liable for non-performance of its obligations under the present Terms and Conditions, if such non-performance on time and / or improper performance, in whole or in part, is due to a force majeure event.

Force majeure is any unpredictable external event, absolutely invincible and inevitable.

  1. Applicable law

The present Terms and Conditions and the use of this site are governed by the laws of Romania. In the event of any dispute regarding the present Terms and Conditions, an amicable settlement will be sought between the parties involved. If no agreement is reached in this way, the disputes will be settled by the competent courts in Romania.
